Approval Management/ Due Diligence

 

For many reasons one can ask oneself, if and to what extent a company complies with the Commodo Law. This is the case, for example, when buying or selling a company. In these cases, it is important to know the exact status of approval compliance in order to be able to correctly assess the company in the context of due diligence.

 

Even if an operation is to be extended or changed, the knowledge of the status quo in terms of the Commodo Law is important in order to be able to choose the correct approach with regard to the adaptation or extension of the operating license(s).Where appropriate, changes or extensions of the operating license can then even be achieved without a complex approval process by "Notifications of operational changes according to Art. 6 of the Commodo Law" (non-substantial modifications; “modifications non substantielles”).

 

Another component of the approval conformity is the implementation of so-called “official inspections"("receptions”), which are requested by the operating licenses and which must be carried out by a licensed body (“organisme agréé”). In particular, the "general inspection" after receipt of an operating license respectively before commissioning as well as regularly recurring individual inspections in the field of water and soil protection have to be mentioned. Among other things, we have the licenses as “organisme agréé” required for the above-mentioned inspections.
